第十二屆全國人民代表大會(huì)常務(wù)委員會(huì)第十次會(huì)議審議了香港特別行政區(qū)行政長官梁振英2014年7月15日提交的《關(guān)于香港特別行政區(qū)2017年行政長官及2016年立法會(huì)產(chǎn)生辦法是否需要修改的報(bào)告》,并在審議中充分考慮了香港社會(huì)的有關(guān)意見和建議。 | The Standing Committee of the Twelfth National People's Congress considered at its Tenth Session the Report on whether there is a need to amend the methods for selecting the Chief Executive of the Hong Kong Special Administrative Region in 2017 and for forming the Legislative Council of the Hong Kong Special Administrative Region in 2016 submitted by Leung Chun-ying, the Chief Executive of the Hong Kong Special Administrative Region, on 15 July 2014. In the course of deliberation, the relevant views and suggestions of the Hong Kong community were given full consideration. |
會(huì)議指出,2007年12月29日第十屆全國人民代表大會(huì)常務(wù)委員會(huì)第三十一次會(huì)議通過的《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于香港特別行政區(qū)2012年行政長官和立法會(huì)產(chǎn)生辦法及有關(guān)普選問題的決定》規(guī)定,2017年香港特別行政區(qū)第五任行政長官的選舉可以實(shí)行由普選產(chǎn)生的辦法;在行政長官實(shí)行普選前的適當(dāng)時(shí)候,行政長官須按照香港基本法的有關(guān)規(guī)定和《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于〈中華人民共和國香港特別行政區(qū)基本法〉附件一第七條和附件二第三條的解釋》,就行政長官產(chǎn)生辦法的修改問題向全國人民代表大會(huì)常務(wù)委員會(huì)提出報(bào)告,由全國人民代表大會(huì)常務(wù)委員會(huì)確定。2013年12月4日至2014年5月3日,香港特別行政區(qū)政府就2017年行政長官產(chǎn)生辦法和2016年立法會(huì)產(chǎn)生辦法進(jìn)行了廣泛、深入的公眾咨詢。咨詢過程中,香港社會(huì)普遍希望2017年實(shí)現(xiàn)行政長官由普選產(chǎn)生,并就行政長官普選辦法必須符合香港基本法和全國人大常委會(huì)有關(guān)決定、行政長官必須由愛國愛港人士擔(dān)任等重要原則形成了廣泛共識(shí)。對于2017年行政長官普選辦法和2016年立法會(huì)產(chǎn)生辦法,香港社會(huì)提出了各種意見和建議。在此基礎(chǔ)上,香港特別行政區(qū)行政長官就2017年行政長官和2016年立法會(huì)產(chǎn)生辦法修改問題向全國人大常委會(huì)提出報(bào)告。會(huì)議認(rèn)為,行政長官的報(bào)告符合香港基本法、全國人大常委會(huì)關(guān)于香港基本法附件一第七條和附件二第三條的解釋以及全國人大常委會(huì)有關(guān)決定的要求,全面、客觀地反映了公眾咨詢的情況,是一個(gè)積極、負(fù)責(zé)、務(wù)實(shí)的報(bào)告。 | The Session points out that according to the Decision of the Standing Committee of the National People's Congress on Issues Relating to the Methods for Selecting the Chief Executive of the Hong Kong Special Administrative Region and for Forming the Legislative Council of the Hong Kong Special Administrative Region in the Year 2012 and on Issues Relating to Universal Suffrage adopted by the Standing Committee of the Tenth National People's Congress at its Thirty-first Session on 29 December 2007, the election of the fifth Chief Executive of the Hong Kong Special Administrative Region in the year 2017 may be implemented by the method of universal suffrage; at an appropriate time prior to the selection of the Chief Executive of the Hong Kong Special Administrative Region by universal suffrage, the Chief Executive shall make a report to the Standing Committee of the National People's Congress as regards the issue of amending the method for selecting the Chief Executive in accordance with the relevant provisions of the Hong Kong Basic Law and the Interpretation by the Standing Committee of the National People's Congress of Article 7 of Annex I and Article III of Annex II to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, and a determination thereon shall be made by the Standing Committee of the National People's Congress. From 4 December 2013 to 3 May 2014, the Government of the Hong Kong Special Administrative Region conducted an extensive and in-depth public consultation on the methods for selecting the Chief Executive in 2017 and for forming the Legislative Council in 2016. In the course of consultation, the Hong Kong community generally expressed the hope to see the selection of the Chief Executive by universal suffrage in 2017, and broad consensus was reached on important principles such as: the method for selecting the Chief Executive by universal suffrage shall comply with the Hong Kong Basic Law and the relevant Decisions of the Standing Committee of the National People's Congress and the Chief Executive shall be a person who loves the country and loves Hong Kong. With respect to the methods for selecting the Chief Executive by universal suffrage in 2017 and for forming the Legislative Council in 2016, the Hong Kong community put forward various views and suggestions. It was on this basis that the Chief Executive of the Hong Kong Special Administrative Region made a report to the Standing Committee of the National People's Congress on issues relating to amending the methods for selecting the Chief Executive in 2017 and for forming the Legislative Council in 2016. The Session is of the view that the report complies with the requirements of the Hong Kong Basic Law, the Interpretation by the Standing Committee of the National People's Congress of Article 7 of Annex I and Article III of Annex II to the Hong Kong Basic Law and the relevant Decisions of the Standing Committee of the National People's Congress, and reflects comprehensively and objectively the views collected during the public consultation; and is thus a positive, responsible and pragmatic report. |
會(huì)議認(rèn)為,實(shí)行行政長官普選,是香港民主發(fā)展的歷史性進(jìn)步,也是香港特別行政區(qū)政治體制的重大變革,關(guān)系到香港長期繁榮穩(wěn)定,關(guān)系到國家主權(quán)、安全和發(fā)展利益,必須審慎、穩(wěn)步推進(jìn)。香港特別行政區(qū)行政長官普選源于香港基本法第四十五條第二款的規(guī)定,即“行政長官的產(chǎn)生辦法根據(jù)香港特別行政區(qū)的實(shí)際情況和循序漸進(jìn)的原則而規(guī)定,最終達(dá)至由一個(gè)有廣泛代表性的提名委員會(huì)按民主程序提名后普選產(chǎn)生的目標(biāo)?!敝贫ㄐ姓L官普選辦法,必須嚴(yán)格遵循香港基本法有關(guān)規(guī)定,符合“一國兩制”的原則,符合香港特別行政區(qū)的法律地位,兼顧社會(huì)各階層的利益,體現(xiàn)均衡參與,有利于資本主義經(jīng)濟(jì)發(fā)展,循序漸進(jìn)地發(fā)展適合香港實(shí)際情況的民主制度。鑒于香港社會(huì)對如何落實(shí)香港基本法有關(guān)行政長官普選的規(guī)定存在較大爭議,全國人大常委會(huì)對正確實(shí)施香港基本法和決定行政長官產(chǎn)生辦法負(fù)有憲制責(zé)任,有必要就行政長官普選辦法的一些核心問題作出規(guī)定,以促進(jìn)香港社會(huì)凝聚共識(shí),依法順利實(shí)現(xiàn)行政長官普選。 | The Session is of the view that implementing universal suffrage for the selection of the Chief Executive represents a historic progress in Hong Kong's democratic development and a significant change in the political structure of the Hong Kong Special Administrative Region. Since the long-term prosperity and stability of Hong Kong and the sovereignty, security and development interests of the country are at stake, there is a need to proceed in a prudent and steady manner. The selection of the Chief Executive of the Hong Kong Special Administrative Region by universal suffrage has its origin in Paragraph 2 of Article 45 of the Hong Kong Basic Law: "The method for selecting the Chief Executive shall be specified in the light of the actual situation in the Hong Kong Special Administrative Region and in accordance with the principle of gradual and orderly progress. The ultimate aim is the selection of the Chief Executive by universal suffrage upon nomination by a broadly representative nominating committee in accordance with democratic procedures." The formulation of the method for selecting the Chief Executive by universal suffrage must strictly comply with the relevant provisions of the Hong Kong Basic Law, accord with the principle of "one country, two systems", and befit the legal status of the Hong Kong Special Administrative Region. It must meet the interests of different sectors of the society, achieve balanced participation, be conducive to the development of the capitalist economy, and make gradual and orderly progress in developing a democratic system that suits the actual situation in Hong Kong. Given the divergent views within the Hong Kong community on how to implement the Hong Kong Basic Law provisions on universal suffrage for selecting the Chief Executive, and in light of the constitutional responsibility of the Standing Committee of the National People's Congress for the proper implementation of the Hong Kong Basic Law and for deciding on the method for the selection of the Chief Executive, the Standing Committee of the National People's Congress finds it necessary to make provisions on certain core issues concerning the method for selecting the Chief Executive by universal suffrage, so as to facilitate the building of consensus within the Hong Kong community and the attainment of universal suffrage for the selection of the Chief Executive smoothly and in accordance with law. |
會(huì)議認(rèn)為,按照香港基本法的規(guī)定,香港特別行政區(qū)行政長官既要對香港特別行政區(qū)負(fù)責(zé),也要對中央人民政府負(fù)責(zé),必須堅(jiān)持行政長官由愛國愛港人士擔(dān)任的原則。這是“一國兩制”方針政策的基本要求,是行政長官的法律地位和重要職責(zé)所決定的,是保持香港長期繁榮穩(wěn)定,維護(hù)國家主權(quán)、安全和發(fā)展利益的客觀需要。行政長官普選辦法必須為此提供相應(yīng)的制度保障。 | The Session is of the view that since the Chief Executive of the Hong Kong Special Administrative Region shall be accountable to both the Hong Kong Special Administrative Region and the Central People's Government in accordance with the provisions of the Hong Kong Basic Law, the principle that the Chief Executive has to be a person who loves the country and loves Hong Kong must be upheld. This is a basic requirement of the policy of "one country, two systems". It is determined by the legal status as well as important functions and duties of the Chief Executive, and is called for by the actual need to maintain long-term prosperity and stability of Hong Kong and uphold the sovereignty, security and development interests of the country. The method for selecting the Chief Executive by universal suffrage must provide corresponding institutional safeguards for this purpose. |
會(huì)議認(rèn)為,2012年香港特別行政區(qū)第五屆立法會(huì)產(chǎn)生辦法經(jīng)過修改后,已經(jīng)向擴(kuò)大民主的方向邁出了重大步伐。香港基本法附件二規(guī)定的現(xiàn)行立法會(huì)產(chǎn)生辦法和表決程序不作修改,2016年第六屆立法會(huì)產(chǎn)生辦法和表決程序繼續(xù)適用現(xiàn)行規(guī)定,符合循序漸進(jìn)地發(fā)展適合香港實(shí)際情況的民主制度的原則,符合香港社會(huì)的多數(shù)意見,也有利于香港社會(huì)各界集中精力優(yōu)先處理行政長官普選問題,從而為行政長官實(shí)行普選后實(shí)現(xiàn)立法會(huì)全部議員由普選產(chǎn)生的目標(biāo)創(chuàng)造條件。 |
The Session is of the view that the amendments made to the method for forming the fifth term Legislative Council in 2012 represented major strides towards the direction of enhancing democracy. The existing formation method and voting procedures for the Legislative Council as prescribed in Annex II to the Hong Kong Basic Law will not be amended, and will continue to apply in respect of the sixth term Legislative Council in 2016. This is consistent with the principle of gradual and orderly progress in developing a democratic system that suits Hong Kong's actual situation and conforms to the majority view in the Hong Kong community. It also helps the various sectors of the Hong Kong community to focus their efforts on addressing the issues concerning universal suffrage for selecting the Chief Executive first, thus creating the conditions for attaining the aim of electing all the members of the Legislative Council by universal suffrage after the implementation of universal suffrage for the selection of the Chief Executive. |
鑒此,全國人民代表大會(huì)常務(wù)委員會(huì)根據(jù)《中華人民共和國香港特別行政區(qū)基本法》、《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于〈中華人民共和國香港特別行政區(qū)基本法〉附件一第七條和附件二第三條的解釋》和《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于香港特別行政區(qū)2012年行政長官和立法會(huì)產(chǎn)生辦法及有關(guān)普選問題的決定》的有關(guān)規(guī)定,決定如下: | Accordingly, pursuant to the relevant provisions of the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, the Interpretation by the Standing Committee of the National People's Congress of Article 7 of Annex I and Article III of Annex II to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China and the Decision of the Standing Committee of the National People's Congress on Issues Relating to the Methods for Selecting the Chief Executive of the Hong Kong Special Administrative Region and for Forming the Legislative Council of the Hong Kong Special Administrative Region in the Year 2012 and on Issues Relating to Universal Suffrage, the Standing Committee of the National People's Congress makes the following decision: |
一、從2017年開始,香港特別行政區(qū)行政長官選舉可以實(shí)行由普選產(chǎn)生的辦法。 | I. Starting from 2017, the selection of the Chief Executive of the Hong Kong Special Administrative Region may be implemented by the method of universal suffrage. |
二、香港特別行政區(qū)行政長官選舉實(shí)行由普選產(chǎn)生的辦法時(shí): | II. When the selection of the Chief Executive of the Hong Kong Special Administrative Region is implemented by the method of universal suffrage: |
(一)須組成一個(gè)有廣泛代表性的提名委員會(huì)。提名委員會(huì)的人數(shù)、構(gòu)成和委員產(chǎn)生辦法按照第四任行政長官選舉委員會(huì)的人數(shù)、構(gòu)成和委員產(chǎn)生辦法而規(guī)定。 | (1) A broadly representative nominating committee shall be formed. The provisions for the number of members, composition and formation method of the nominating committee shall be made in accordance with the number of members, composition and formation method of the Election Committee for the Fourth Chief Executive. |
(二)提名委員會(huì)按民主程序提名產(chǎn)生二至三名行政長官候選人。每名候選人均須獲得提名委員會(huì)全體委員半數(shù)以上的支持。 | (2) The nominating committee shall nominate two to three candidates for the office of Chief Executive in accordance with democratic procedures. Each candidate must have the endorsement of more than half of all the members of the nominating committee. |
(三)香港特別行政區(qū)合資格選民均有行政長官選舉權(quán),依法從行政長官候選人中選出一名行政長官人選。 | (3) All eligible electors of the Hong Kong Special Administrative Region have the right to vote in the election of the Chief Executive and elect one of the candidates for the office of Chief Executive in accordance with law. |
(四)行政長官人選經(jīng)普選產(chǎn)生后,由中央人民政府任命。 | (4) The Chief Executive-elect, after being selected through universal suffrage, will have to be appointed by the Central People's Government. |
三、行政長官普選的具體辦法依照法定程序通過修改《中華人民共和國香港特別行政區(qū)基本法》附件一《香港特別行政區(qū)行政長官的產(chǎn)生辦法》予以規(guī)定。修改法案及其修正案應(yīng)由香港特別行政區(qū)政府根據(jù)香港基本法和本決定的規(guī)定,向香港特別行政區(qū)立法會(huì)提出,經(jīng)立法會(huì)全體議員三分之二多數(shù)通過,行政長官同意,報(bào)全國人民代表大會(huì)常務(wù)委員會(huì)批準(zhǔn)。 | III. The specific method of universal suffrage for selecting the Chief Executive shall be prescribed in accordance with legal procedures through amending Annex I to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China: The Method for the Selection of the Chief Executive of the Hong Kong Special Administrative Region. The bill on the amendments and the proposed amendments to such bill shall be introduced by the Hong Kong Special Administrative Region Government to the Legislative Council of the Hong Kong Special Administrative Region in accordance with the Hong Kong Basic Law and the provisions of this Decision. Such amendments shall obtain the endorsement of a two-thirds majority of all the members of the Legislative Council and the consent of the Chief Executive before being submitted to the Standing Committee of the National People's Congress for approval. |
四、如行政長官普選的具體辦法未能經(jīng)法定程序獲得通過,行政長官的選舉繼續(xù)適用上一任行政長官的產(chǎn)生辦法。 | IV. If the specific method of universal suffrage for selecting the Chief Executive is not adopted in accordance with legal procedures, the method used for selecting the Chief Executive for the preceding term shall continue to apply. |
五、香港基本法附件二關(guān)于立法會(huì)產(chǎn)生辦法和表決程序的現(xiàn)行規(guī)定不作修改,2016年香港特別行政區(qū)第六屆立法會(huì)產(chǎn)生辦法和表決程序,繼續(xù)適用第五屆立法會(huì)產(chǎn)生辦法和法案、議案表決程序。在行政長官由普選產(chǎn)生以后,香港特別行政區(qū)立法會(huì)的選舉可以實(shí)行全部議員由普選產(chǎn)生的辦法。在立法會(huì)實(shí)行普選前的適當(dāng)時(shí)候,由普選產(chǎn)生的行政長官按照香港基本法的有關(guān)規(guī)定和《全國人民代表大會(huì)常務(wù)委員會(huì)關(guān)于〈中華人民共和國香港特別行政區(qū)基本法〉附件一第七條和附件二第三條的解釋》,就立法會(huì)產(chǎn)生辦法的修改問題向全國人民代表大會(huì)常務(wù)委員會(huì)提出報(bào)告,由全國人民代表大會(huì)常務(wù)委員會(huì)確定。 | V. The existing formation method and voting procedures for the Legislative Council as prescribed in Annex II to the Hong Kong Basic Law will not be amended. The formation method and procedures for voting on bills and motions of the fifth term Legislative Council will continue to apply to the sixth term Legislative Council of the Hong Kong Special Administrative Region in 2016. After the election of the Chief Executive by universal suffrage, the election of all the members of the Legislative Council of the Hong Kong Special Administrative Region may be implemented by the method of universal suffrage. At an appropriate time prior to the election of the Legislative Council by universal suffrage, the Chief Executive elected by universal suffrage shall submit a report to the Standing Committee of the National People's Congress in accordance with the relevant provisions of the Hong Kong Basic Law and the Interpretation by the Standing Committee of the National People's Congress of Article 7 of Annex I and Article III of Annex II to the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China as regards the issue of amending the method for forming the Legislative Council. A determination thereon shall be made by the Standing Committee of the National People's Congress. |
會(huì)議強(qiáng)調(diào),堅(jiān)定不移地貫徹落實(shí)“一國兩制”、“港人治港”、高度自治方針政策,嚴(yán)格按照香港基本法辦事,穩(wěn)步推進(jìn)2017年行政長官由普選產(chǎn)生,是中央的一貫立場。希望香港特別行政區(qū)政府和香港社會(huì)各界依照香港基本法和本決定的規(guī)定,共同努力,達(dá)至行政長官由普選產(chǎn)生的目標(biāo)。 |
The Session stresses that it is the consistent position of the central authorities to implement resolutely and firmly the principles of "one country, two systems", "Hong Kong people administering Hong Kong" and a high degree of autonomy, strictly adhere to the Hong Kong Basic Law and steadily take forward the selection of the Chief Executive by universal suffrage in 2017. It is hoped that the Hong Kong Special Administrative Region Government and all sectors of the Hong Kong community will act in accordance with the provisions of the Hong Kong Basic Law and this Decision and jointly work towards the attainment of the aim of selecting the Chief Executive by universal suffrage. |
