Power of Supervision
Exercising supervision is an important function and power granted to the people’s congresses and their standing committees by the Constitution and the law. An important principle of the system of people’s congresses and a basic implication of this power is that any state organ and its functionaries must have their powers under checks and supervision.
The NPC and its Standing Committee exercise the following power of supervision:
? to organize inspections of law enforcement;
? to hear and review reports on the assigned work of relevant state organs;
? to hear and review reports on the implementation of relevant plans and budgets, and audit reports, and review and approve final accounts;
? to record and review the administrative regulations, local regulations, regulations on the exercise of autonomy, separate regulations, judicial interpretations, and other normative documents;
? to conduct special inquiries and questioning and investigate special subjects.
行使監(jiān)督權
監(jiān)督權是憲法和法律賦予人大及其常委會的一項重要職權。人民代表大會制度的重要原則和制度設計的基本要求,就是任何國家機關及其工作人員的權力都要受到制約和監(jiān)督。
全國人大及其常委會的監(jiān)督工作主要包括:組織執(zhí)法檢查,對法律的實施情況進行檢查監(jiān)督;聽取和審議有關國家機關專項工作報告;聽取審議計劃、預算的執(zhí)行情況報告和審計工作報告,審查和批準決算等;對行政法規(guī)、地方性法規(guī)、自治條例和單行條例及司法解釋等規(guī)范性文件進行備案審查;開展專題詢問、質(zhì)詢、特定問題調(diào)查等。
